Tavern Accused Of Over Serving A Customer

An establishment that serves alcohol in Pennsylvania may be held liable if it over-serves a patron and the patron ends up harming somebody due to being intoxicated. One individual in a recent out-of-state case said he was injured by an inebriated individual at a tavern. He has thus sued the business, accusing it of over-serving a customer.

According to his complaint, the man was at the tavern one day when employees there sold alcohol to another man. The other man reportedly became drunk at the tavern. He is said to have then attacked and beat up the plaintiff without provocation.

The plaintiff asserted that due to the assault, he suffered both internal and external injuries. As a result, he allegedly cannot handle his normal affairs and duties. He also claimed to have accrued huge medical bills and says he will continue to do so.

As part of his suit, alleging negligence and violations of the Dram Shop Act on the part of the tavern, the plaintiff is seeking a jury trial as well as damages. When a business in Pennsylvania is found to have been over-serving a customer who causes harm to someone while intoxicated, the victim has the right to seek justice through the civil court system. Although awarded damages may not be able to undo the events leading to a person’s injury in a Dram Shop liability case, the monetary compensation may help the victim to experience a sense of closure and thus more easily move forward from the ordeal.
