Frequently Asked Questions About Motorcycle Accident Claims in PA

Do I have to wear a helmet while riding a motorcycle in Western Pennsylvania?

While wearing a helmet is always advisable for your own safety, you do not legally have to wear a helmet while riding a motorcycle in Pennsylvania if you are at least 21 years old and have been licensed to drive a motorcycle for at least two years.  In the alternative, you may ride without a helmet if you have completed an approved course designed to ensure motorcycle safety (passengers on motorcycles are not subject to this requirement and may ride without a helmet if they are at least 21 years old).

What if no one witnessed my motorcycle accident?  How can a lawyer help establish that I was not responsible?

We can work with forensic experts who specialize in accident reconstruction to gather evidence as to what happened in your accident.  In other cases, we can present evidence regarding your driving record and any evidence that you have completed a motorcycle safety class.  We can also challenge the other driver’s safety record and attempt to gain evidence as to what might have been happening in that driver’s vehicle at the time of the accident—including whether that driver was using his or her phone.  Remember, you are not automatically considered at fault for the accident simply because you were driving a motorcycle. While every case is different, we will work to locate various forms of evidence to use in your favor.

If I waived my uninsured/underinsured motorcycle coverage, can I still collect compensation for my injuries following a motorcycle accident?
