Workers who are injured in the course of their employment duties are entitled to workers’ compensation benefits. In recognition of the risks of police or firefighting work, officers and firefighters are entitled to a unique workers’ compensation benefit in Pennsylvania known as the Heart and Lung Act, which pays an injured police officer or firefighter 100 percent of their regular salary, tax-free, as opposed to two-thirds regular salary available under normal workers’ compensation. Generally speaking, an injured police officer or firefighter may be entitled to file a personal injury claim against a person or entity (other than their employer) who bears responsibility for the officer’s or firefighter’s injury, such as if an officer is assaulted by a suspect, or if a firefighter is injured by defective equipment.
