Premises Liability Suit Filed Following Girls Death At Car Show

October 1, 2015

When businesses fail to keep their properties safe for the public to use in Pennsylvania, this can quickly lead to serious injuries or even death. One family in another state said a girl, 7, was killed when she was struck by an automobile at a car show, and they are blaming a few businesses as well as several individuals for her death. The family, including the girl’s brother and parents, recently filed a premises liability lawsuit against these parties.

The car show’s purpose was to reveal lowrider cars featuring custom hydraulics that cause vehicles to jump several feet. In many cases, the cars jump above audience members’ heads. According to the lawsuit, the girl was hit by one of the vehicles in the show.

The girl ended up being killed at about 7:30 p.m. in a warehouse. The warehouse was named in the lawsuit along with three businesses and two drivers. Other defendants in the claim include trusts and individuals who own the warehouse property. Two other spectators at the event are also plaintiffs in the lawsuit. The plaintiffs’ suit alleges premises liability as well as negligence, wrongful death and negligently inflicting emotional distress.

As part of the premises liability suit, the plaintiffs are seeking an unspecified amount in damages. When a person in Pennsylvania is killed as a result of a business owner’s failure to maintain his or her property in a safe condition, this property owner may be held financially responsible for the death. The surviving loved ones of the deceased victim have the right to explore all of their legal options in an effort to hold the property owner accountable.
